Japanese Certificate to hold the key in imported car odometer tampering case. A parramatta road used car dealership has been accused of misleading or deceptive conduct over an alleged odometer wind-back of nearly 100,000 km. Tristan Hart claims the imported 1998 model Nissan Stagea RS260 he bought from Edward Lee's Jaapanese Auto Center at Concord with an odometer reading of 62,000 km had actually travelled 155,000 km. Mr Hard paid $20,500 for the car. But he says he sought a second opinion that the estimated true worth is only about $9000. In the NSW Civil and Administrative Tribunal in Sydney yesterday he applied for compensation for the difference, as well as the cost of replacing the tyres that he said were not roadworthy. Mr Hard told NCAT that the dealership had engaged in misleading or deceptive conduct by selling him a car for significantly more than it was worth. He said his main evidence was the registration certificate issued by Japan's Ministry of Land Infrastructure, transport and tourism showing the Stagea had been driven 154,900km before being shipped to Australia. Edward Lee's dealer Phil Lee told the tribunal he was likely to challenge the veracity of the document by flying to Jpaan to get it checked. "Nobody knows really how authentic it is" Mr Lee said "It could be a forgery or a fake. I want to take it to Japan and get an expert to give me an opinion on it." He asked NCAT sneior member Mark Cohen for a month to be able to do that. He was granted a week. Mr Lee said the document was not enough to "hang a legal case on". Mr Cohen said it was "more than enough". Because the registration certificate had not been serve on the respondent, the matter was adjourned. Mr Cohen gave direction that within seven days Mr Hard provide Mr Lee with the certificate as well as a translation and any other evidence nhe planned to rely on. Mr Lee would then have seven days to file a written challenge. Mr Cohen said that if the document translates "in the way I suspect, I'm not sure you'd be able to oppose the application". Allegations of odometer tampering are a significant problem throughout NSW. I'll be following the developments in this case. Quote

I also did a search and found that Edward Lee's Japanese Auto Centre P/L is a current member of the MTA (Motor Traders' Association of New South Wales). Here are a couple of small excerpts from the MTA's code of ethics; "MTA members will: - act honestly and fairly in all dealings with the public and conduct business with strict professional courtesy and integrity ... - not knowingly mislead a consumer in relation to the condition of a vehicle or be a party to improper practice in relation to the sale or purchase of a vehicle ..." I doesn't give me much confidence in MTA membership, which I have previously regarded as a good sign. Good luck Mr Hart. Quote

My apprentice bought a EP3 civic from them, i went with him there, he knew the owner, we all actually spoke at length about dodgy dealers and winding back odometers with the owner mentioning edward lees. Guess what, they got done for the same thing, closed business, opened again trading under team wyld speed or something in wetherill park. this "new" shop does things on a smaller scale, imports privatly i think, sells a few off on the side, its more of a parts importing place now but same story, they close one down, they open up again.
