BatmansDatsun Posted September 2, 2013 Posted September 2, 2013 Hey guys Hope this is in the right spot, if not let me know. Coming home from work today and turned into my street. There is a nice crest about 5 houses before mine and as I just rebuilt the engine I have been taking any hill as a chance to push the car the help give it a wide range of driving to settle the engine. So I slowed down to almost a stop and put the car in 2nd and flattened it to 60 K then backed off. One of the neighbors was outside and yelled obscenities at me so i just flipped him off and coasted down to my place. within me literally walking inside, getting a beer and lighting a smoke this bloke drives down my driveway and I confronted him. I knew it was him as I have seen the car before, I told him to get off my property as this is trespassing and he just sat there wrote down my plates and started going on about he will ensure i won't have a license by next week. So of course I took down his number plate also. Look I'm not overly concerned as well i was doing the speed limit, i always do (but in a lower gear when its cold the carby doesn't like it) so what do you guys think of people like this? To me it seems like he has some issues and needs to get some help or get over it. I will admit the car is loud when I'm accelerating to 60 but its still within the legal limit by a mile. Also my area is not a small area we are all on 3-5 acre blocks and the speed limit is posted as 60 at the start of the street. Should I be concerned or should I not worry about it. Cheers Nic Quote
BatmansDatsun Posted September 2, 2013 Author Posted September 2, 2013 One a side note.. it goes pretty damn well and its all up and running Quote
nizm0zed Posted September 2, 2013 Posted September 2, 2013 should you be concerned? No, probably not. From a purely legal standpoint there is no evidence for or against either parties complaint/defence. Eg, your word against his. So, if cops cant be arsed going after half the 'crimes' reported to them i seriously doubt they'll bother with this. At most you may get a phonecall or a bored officer making an appearance to 'calm the peace' As for writing down licence plates, no its not illegal, anyone can write down anything they want. My suggestion? Drop 2 fat black marks all over his driveway and onto his lawn at about 2am, make sure your hanging out the window and giving him the one finger salute. When he comes out raging at you, stop mid doughnut on his lawn, punch him in the rooster and shred up the street. actually, this isnt boostcruising so you should probably ignore that advice Quote
ZED83 Posted September 2, 2013 Posted September 2, 2013 I wouldn't worry, I've had that before! Passed an old fart (no offence to any one hear) on the left then went in front of him cause he just sat there an didn't pass. Then I stopped at the lights he pulled up next to me yelling so I wound down the window he said I've wrote down your number plate!! All I said was thank's, good for you. nothing happened. Quote
Scoota G Posted September 2, 2013 Posted September 2, 2013 They'll either get used to you or move (my neighbour did the latter) short story he has nothing. Best advice is don't poo in your own bed! On another note i've had people get upset at me just parking in the supermarket. Keep a note of it (written) and if they do it again get a restraining order. Quote
Gordo Posted September 2, 2013 Posted September 2, 2013 I would suggest find another hill close buy with no houses on it. Just to keep the peace. Some times it's just not worth the pain. Quote
JDSM Posted September 2, 2013 Posted September 2, 2013 I wouldn't be too fussed about it, people generally need photographic evidence or similar to back up their claims for traffic court related stuff. Classic he said this, you said that, court or the local constabulary wouldn't worry too much in this particular situation. Probably, if something were to happen, look to Transport Operations (Road Use Management) Act s 86 (speed trails, etc). https://www.legislation.qld.gov.au/LEGISLTN/CURRENT/T/TrantOpRUA95.pdf Or look at your criminal code, but doesn't really sound like dangerous driving if noise was within the relevant dB range (no idea what that is for you guys) and no sort of unnecessary smoke. Sounds like my current landlords, nothing better to do than get flustered about the little things, you can't win, can't wait to move again! Don't worry about it and smile a lot on the inside next time you 'bother' them. Relax Oh, and pretty sure people can write number plates down if they like... Quote
MyEnquiringMind Posted September 2, 2013 Posted September 2, 2013 and worst case scenario... plenty of ways to play it legally... familiarize yourself with the below and try and play it sweet in front of him, his word against yours wont count for shit, but video evidence will... https://www.legislation.qld.gov.au/LEGISLTN/ACTS/2002/02AC033.pdf Cheers, J Quote
BatmansDatsun Posted September 2, 2013 Author Posted September 2, 2013 Thanks guys you have all pretty summed up my opinion on it, i was just wondering what you all thought.. There are loads of hills out the back of mine where people are on 20-30 acres and that's normally my drive line. I was just on the way home and thought eh... why not. The taking down plates issue is something i know is perfectly legal. but the coming onto my property (200M driveway) is what i thought was a bit over the top. I mean come on how pathetic is that. and the photo's or videos really can't stand up in a court of law, there is no way to verify that the speed I was traveling was over 60. Ill just make sure to key bang it past his every morning. Quote
JDSM Posted September 2, 2013 Posted September 2, 2013 Yeah, that is a pretty douche move coming up the driveway, but if the gate or whatever was not closed then that is fine as far as I'm aware (not a trespass expert though, haha). A VZ Maloo belonging to guys across the road (great blokes) is often known to pull massive burnouts down my street every month or so when they have a party (this is about 1KM outside of the CBD, mind you). I'm the guy with the red car, so I often get blamed by my landlord, which I wont get into. I normally tell them they are entitled to their opinion and politely disagree and then walk away. Generally works AS LONG AS YOU DO THE RIGHT THING. No sense in purposely agitating your neighbors, although it is fun Quote
Hamiton Posted September 11, 2013 Posted September 11, 2013 Don't bother with this since the cops won't. There is no proof of anything, it's you vs him because of no evidence. So to be honest, don't bother and forget about it Quote
neRok Posted September 11, 2013 Posted September 11, 2013 From what ive read (very little) about the new laws in QLD, youre f--d! You can get done for undue noise afaik. Stopping on a hill and taking off is not normal, and from the blokes perspective you were probably trying to hoon. If the cops come knocking, I would be careful telling your story to the cops the way you did here. Just say its a new engine in an old car, it stalled on the hill, you restarted and drove off. Quote
