Ok Guys here is the problem, that i guess is complex, but will say it as simple as i can from my Point of view.

 

1. Sold car on Ebay, 280z, for close to $500, sold in bad condition

2. guy that buys it, pays fantastic, quick, and we oraganize for him to pick it, I am not at my house and had a couple of frothys, so i do not have transfer paper or spare wheel etc but tell him i will bring it round to my work tomorrow where he can pick it them up but he is  welcome to take the car. We have a short discussion about the car, i even mention how great this forum is :), when i mention that the rego will need re-doing shortly, he memtions he is considering not re-regersting it as he is thinking of doing it up for his daugter.

 

3. My Bad, I stuff up and next morning forget to bring the bits into work, so yes, i let him down by not havin them. From the next day I made sure i Had them there!

 

4. For the next few week i not see him come into work, i presume he has decided to do it up and the parts are not important. so with a bit on in my life i forget about it.

 

 

5. I then get a $100 fine in post for not handing the plates in, as the car has run out of rego, i swear a bit, i rant a bit, in the end i go down the licencing depart and pay the fine and sign a stat dec to say i not have have the plates anymore.

 

6. I see on the 20th of this month the guy has had a rant on this site, as also quite rightly he has some grievances.

SO NOW I AM CONFUSED AS WHAT TO DO

 

(keepin in mind nothing much can happen in the next few weeks as still recovering from surgery)

In SA there are 2 halfs of the rego papers, one for the buyer and one for the seller. Its the buyers responsibility to lodge it with the Govt and pay stamp duty, and optional for the seller, but if you do it covers your but as the seller and avoids the "out of rego; speeding fine; car involved in armed robbery" or any other scenario that could happen.

60 Cents on a stamp could have solved your transfer paper problem, but it may be a bit late for that now.

Yep - you stuffed up by not making sure you had your stuff ready to go the very next day, but we're all human. He stuffed up by not making sure he had the stuff and following it up. A few phone calls between the two of you should have seen this sorted. I don't see any need for any further action, keep the scenario exactly as it is and both get on with life.

Not too sure what the rules are over there but here in vic if I sell a car with rego a RWC is supplied, if not I take the plates off return them to vic roads and cancel the rego.

yup, little bit of a stuff up on your behalf.... lesson learnt.

a transaction is really not complete unless both parties have signed the "notice of disposal" for the vehicle or alternatively plates handed in. Never make assumptions on what you think the other party might do. Always make sure you dot the I's & cross the T's, and that means proper paperwork.

I take it he now has the appropriate rego papers. If you only copped a $100 fine, count yourself lucky he didnt clock up 3 parking fines and/or got picked up on a redlight camera.  :o

If selling a registered car in WA both seller and buyer have 2 halves of the paperwork, and both are required to send them in. 

 

Now the car is out of rego, he's got an unregisterd car and you've been fined $100. Just chalk it up to experiace and not make the same mistake next time. Nothing else can be done.

 

I got fined for not returning plates once. Still have them. I figure I've paid $100 bucks for them so i'm keeping them. ;D
