Are you saying you won it and he sold it to someone else.... if you sell something on ebay thats a legally binding contract.

If this bloke has done what you said and sold it after the eBay auction was over that's not right and wouldn't leave it at that I would be seeking legal advice.

YellowRX Posted October 25, 2010 Author Posted October 25, 2010 Hi everyone, just to clarify my situation on all this because I thoroughly enjoy my zeds and dealing with many of you guys. I had sold many parts to people from this forum on eBay before without a hitch. I sold the motor to zomb13, he said he would pickup it up 4 days later on a wed night after work and wasn’t paying for it until then. On my own accord I prepared the engine that night and had it hanging on a block and tackle to be dropped into a trailer with all items boxed to go. I waited and waited, no call, no sms, no eBay msg. I cancelled my late plans that night in case he was just running late. He never turned up. I eBay messaged him the early morning to ask what happened as I was waiting. That following day I sold it for $300 less to a member on this forum whom came and picked it up immediately. zomb13 did finally sms me the next day and claimed he never got my emails even though I have records of every one. I have been burned before on eBay by non payers and in my eyes zomb13 was another time waster that could have easily called me and I would have been more than happy to help out any way I can and arrange another suitable pickup time. Rather than file a dispute with eBay I just moved on as he only had a (0) rating so I wasn’t expecting much. zomb13 has since left my first negative feedback on eBay ever, that is his opinion and he is entitled to it. I have plenty Z parts to sell and I only ask people communicate better in future.

I'd call it a failure in communication from both ends really. I understand your frustration YellowRX, but surely you had the option to ask for his phone number? I'm sure a quick call would have averted all of this drama. When you sold the motor to someone else you knew that there was a risk he would still want it. And zomb13, I personally hate it when people don't follow through on commitments, from the sounds of it you didn't make it easy for him. If I'm ever organising a pickup or delivery of items, especially ones that will require preparation, I always try to get a number so I can call if they don't show.

But, It's a two way street though and if you make a commitment stick to it. Yellow RX sold it in the end and Zomb13 is getting his motor rebuilt.......
